Point Effects

The Maryland Motor Vehicle Administration maintains a point system for all moving violations.  The effect of accumulated points are as follows:

3 Points
Warning letter in the mail
5 Points
Require licensee to attend a conference
(except for professional drivers with class a A, B, or C, License)

8 Points

Require licensee to attend a conference
(professional drivers with class a A, B, or C, License)
License suspension hearing¹

12 Points

License revocation hearing¹
¹ If the suspension or revocation of a license would adversely affect the employment or opportunity for employment of a licensee, the hearing officer may decline to order a suspension or revocation, or cancel or modify the suspension or revocation.  If licensee is required to drive a motor vehicle in the course of regular employment, suspension requires 16 points, and revocation requires 19 points.

Duration of Suspension

Suspensions for points not including DWI/DUI

 An initial suspension may not be less than 2 days, nor more than 30 days
Any subsequent suspension may not be less than 15 days, nor more than 90 days
Suspensions for points related to DUI/DWI
For a first conviction, not more than 9 months
For a second conviction at lest 5 years after the date of the first conviction, not more than 9 months
For a second conviction less than 5 years after the date of the first conviction, or for a third conviction, not more than 12 months
For a fourth or subsequent conviction, not more than 24 months

Suspensions for points related to DUI/DWI
Ignition Interlock System Program

For a first conviction, up to 15 days, provided the individual maintains the the interlock system for not more than 5 months
For a second conviction at least 5 years after the date of the first conviction, up to 45 days, provided the individual maintains the the interlock system for not more than 9 months
For a second conviction less than 5 years after the date of the first conviction, or for a third conviction, provided the individual maintains the the interlock system for not more than 12 months
For a fourth or subsequent conviction 6 months, provided the individual maintains the the interlock system for not more than 24 months
